Personal Data Protection Notice

This Personal Data Protection Notice has been prepared by Hostingtry Information Technologies (“Hostingtry”), acting as the data controller, in accordance with the Turkish Personal Data Protection Law No. 6698 (“KVKK”), for the purpose of informing data subjects about the principles regarding the processing of personal data.

2. Categories of Processed Personal Data

The following categories of personal data may be processed:

  • Identity Information (Name, Surname, Company Name, Tax ID)
  • Contact Information (Phone number, email address, physical address)
  • Financial Data (Payment information – card data is not stored by Hostingtry)
  • IP / Traffic Data (processed in accordance with BTK log retention obligations)
  • Usage Data (website behavior data, form contents, shopping cart information)

3. Purposes of Processing Personal Data

  • Providing services, establishing and performing contracts
  • Sale of products and services, domain registration processes, invoicing
  • Managing customer support and technical support operations
  • Fulfilling legal obligations under BTK, Tax Law, and Turkish Commercial Code
  • Ensuring cybersecurity, fraud detection, and prevention of misuse
  • Sending promotional, campaign, and informational communications (with user consent)

4. Legal Grounds for Processing

Personal data is processed based on the legal grounds set forth under Articles 5 and 6 of KVKK:

  • Necessity for the establishment and performance of a contract
  • Compliance with legal obligations (BTK traffic logs, invoicing records, etc.)
  • Legitimate interest for security and operational requirements
  • Explicit consent (marketing communications, newsletters, advertisements)

5. Transfer of Personal Data

Personal data may be transferred only to the following parties where necessary:

  • Tax authorities, BTK, and other authorized public institutions
  • Payment service providers, virtual POS systems, and banking infrastructures (Hostingtry does not store card data)
  • Domain registration and WHOIS service providers (name and email may be mandatory)
  • Contracted infrastructure providers (data centers, email services, CDN providers, etc.)

6. Data Retention Periods

Personal data is retained for the periods required by applicable legislation:

  • Tax and invoicing records: 5 years
  • BTK traffic logs: 2 years
  • Contract-related records: 10 years

7. Rights of Data Subjects (Article 11 of KVKK)

Data subjects may apply to Hostingtry to:

  • Learn whether their personal data is being processed
  • Request correction of incomplete or inaccurate personal data
  • Request deletion or destruction of personal data after legal retention periods
  • Object to data processing activities
  • Learn the third parties to whom personal data is transferred
  • Object to processing carried out exclusively by automated systems
  • Withdraw previously given explicit consent
