TERMS OF SERVICE

This Terms of Service Agreement (“Agreement”) is entered into electronically between Hostingtry Veri Merkezi Bilişim Hizmetleri Ltd. Şti. (“Hostingtry”), the service provider offering products and services through the domain www.hostingtry.com and its subdomains, and the real or legal person (“Customer”) who creates an account, places an order, or purchases services through the website.

By registering, placing an order, making a payment, or using Hostingtry services in any manner, the Customer declares, acknowledges, and undertakes that they have read, understood, and fully accepted the provisions of this Agreement.

1. PARTIES AND DEFINITIONS

1.1. Hostingtry is the service provider offering hosting services, domain name registration, virtual servers (VPS/VDS), physical/dedicated servers, licenses, email, and similar products and services through www.hostingtry.com and its subdomains.

1.2. Customer refers to real persons, legal entities, public institutions, or other organizations that create an account, order, and/or purchase products or services from Hostingtry.

1.3. By approving this Agreement, the Customer declares and undertakes that they have the legal capacity to enter into a binding contract under applicable law, are over 18 years of age, or, if acting on behalf of a legal entity, are duly authorized to represent and bind such entity.

1.4. If it is later determined that the Customer acted without proper authorization on behalf of a legal entity, the Customer accepts personal liability for all obligations arising from this Agreement.

2. SUBJECT AND SCOPE OF THE AGREEMENT

2.1. This Agreement governs the nature of the services provided by Hostingtry, terms of use, rights and obligations of the parties, pricing principles, suspension, and termination conditions.

2.2. Technical specifications of services are limited to those stated on the relevant product pages, order screens, customer panel, campaign texts, or documentation. The Customer accepts that the specifications displayed at the time of ordering shall prevail.

2.3. This Agreement constitutes an integral whole together with Hostingtry’s refund policy, domain registration and renewal policy, privacy and cookie policy, KVKK Information Notice, and all other supplementary policies published on the website. The Customer agrees to comply with all such documents.

3. SERVICE ACTIVATION AND ACCOUNT INFORMATION

3.1. After the Customer’s order and/or payment is received, the relevant service is activated as soon as possible following technical and financial verification. Activation time may vary depending on service type and infrastructure availability.

3.2. Upon activation, access credentials such as control panel, FTP, database, and email information are delivered to the Customer via the registered email address or customer panel.

3.3. The Customer is solely responsible for maintaining the confidentiality of usernames, passwords, and access credentials. Hostingtry shall not be liable for damages arising from unauthorized use or disclosure.

3.4. The Customer is responsible for keeping their contact information accurate and up to date. Any damages arising from incorrect or outdated information shall be borne by the Customer.

4. CUSTOMER OBLIGATIONS

4.1. The Customer agrees to use the services in compliance with applicable laws, public morality, internet usage standards, and all policies and rules announced by Hostingtry.

4.2. The Customer is solely responsible for all content, data, files, software, email traffic, and services hosted or provided to third parties through the service. Ensuring compliance with law, intellectual property rights, personal rights, data protection regulations, and other legislation is the Customer’s responsibility.

4.3. Hostingtry has no obligation to pre-screen or monitor hosted content. However, Hostingtry reserves the right to remove content, suspend services, or notify authorities without prior notice if unlawful content is detected or reasonably suspected.

4.4. The following content and activities are strictly prohibited and may violate applicable laws and Hostingtry’s acceptable use policy:

• Hack, crack, warez, pirated software, unlicensed programs, keygens, serials,
• Adult, pornographic, child exploitation, violence, hate speech, racism, or terrorist propaganda,
• Copyright-infringing distribution of movies, series, music, games, or software,
• Illegal betting, gambling, Ponzi or pyramid schemes, unauthorized financial services,
• Spam, bulk unsolicited emails, phishing, fake banking or payment pages,
• DDoS attacks, brute-force attempts, port scanning, malware hosting or distribution,
• Using shared hosting as file storage, backup space, video archive, or CDN-like services,
• Applications or scripts that excessively and continuously consume server resources.

4.5. The Customer is primarily responsible for backing up all data. Hostingtry may perform periodic backups for service quality purposes; however, this does not constitute a guarantee. The Customer must take necessary precautions against data loss.

4.6. Customers wishing to resell services or create sub-reseller structures must use appropriate reseller, VDS, or dedicated server packages. Unauthorized resale via shared hosting plans is prohibited.

5. HOSTINGTRY OBLIGATIONS AND LIMITATION OF LIABILITY

5.1. Hostingtry shall make reasonable efforts to provide services in accordance with generally accepted technical standards and published SLA/uptime targets.

5.2. Temporary service interruptions may occur due to power outages, network failures, hardware or software issues, cyberattacks, maintenance, or extraordinary traffic. Hostingtry shall take reasonable measures to resolve such issues promptly but shall not be liable for indirect damages such as loss of profit or reputation.

5.3. Hostingtry’s liability for data loss or damages shall in any case be limited to direct damages and shall not exceed the total service fees paid by the Customer in the last three (3) months.

5.4. Hostingtry reserves the right to perform infrastructure updates, maintenance, improvements, capacity expansions, or data center changes. Customers will be notified in advance where reasonably possible.

6. PRICING, BILLING, AND PAYMENT

6.1. Service fees are those displayed on the order screens, price lists, or campaign pages at the time of purchase.

6.2. Fees are collected in advance for the selected billing period. Services will not be activated or renewed without payment.

6.3. Invoices are issued electronically in accordance with applicable tax regulations and sent to the registered email address.

6.4. Hostingtry reserves the right to charge late fees, exchange rate differences, collection costs, and legal fees for overdue payments.

6.5. Hostingtry may revise prices and tariffs prospectively. Changes take effect from the next renewal period after announcement.

7. SUSPENSION, RESTRICTION, AND TERMINATION

7.1. Hostingtry may suspend, restrict, or terminate services partially or fully under the following circumstances:

• Failure to fulfill payment obligations,
• Violation of laws or Agreement terms,
• Excessive resource usage affecting other customers,
• Spam, DDoS, malware, or security abuse,
• Serious complaints from third parties or authorities,
• Abusive or threatening behavior toward Hostingtry or its staff.

7.2. During suspension, the Customer is not entitled to refunds or discounts unless explicitly stated under SLA policies.

8. TERM AND TERMINATION OF THE AGREEMENT

8.1. This Agreement enters into force upon electronic approval or service use and remains valid for the selected billing period, automatically renewing unless terminated.

8.2. The Customer may terminate services via the customer panel or written/email notice. No refunds are issued for unused periods unless stated otherwise.

8.3. In case of justified termination due to violations, no refunds shall be made, and the Customer shall be liable for any damages incurred by Hostingtry.

9. CONFIDENTIALITY AND PERSONAL DATA

9.1. Parties shall keep confidential all commercial, financial, and technical information obtained under this Agreement, except where disclosure is required by authorities.

9.2. Personal data is processed in accordance with applicable data protection laws. Details are provided in the Privacy Policy and KVKK Information Notice.

10. FORCE MAJEURE

10.1. Neither party shall be liable for failure to perform obligations due to force majeure events beyond reasonable control.

10.2. If force majeure persists for more than 15 days, either party may terminate the Agreement by written notice.

11. EVIDENTIARY AGREEMENT

11.1. Hostingtry’s electronic records, logs, emails, and system records shall constitute conclusive evidence under applicable procedural law.

12. GOVERNING LAW AND JURISDICTION

12.1. This Agreement shall be governed by the laws of the Republic of Türkiye.

12.2. Courts and enforcement offices at Hostingtry’s registered office shall have exclusive jurisdiction.

13. EFFECTIVE DATE AND ACCEPTANCE

13.1. This Agreement consists of 13 articles and becomes effective upon electronic approval or use of services.

13.2. Hostingtry may update this Agreement unilaterally. Updated terms take effect upon publication on www.hostingtry.com.
